Terms of Service

Effective date: 23 December 2025

These Terms of Service ("Terms") govern the contractual relationship between you ("Customer") and the operator of the Pondr service ("Pondr", "we", or "Seller") in accordance with Act No. 89/2012 Coll., the Civil Code of the Czech Republic.

2. Description of the Service

Pondr provides a highly personalized, made-to-order printing service.

Based on the Customer's order, Pondr:

  • Technically processes articles selected or provided by the Customer.
  • Generates a unique, print-ready PDF file.
  • Procures the physical production and delivery of a printed magazine via a third-party printer.

Pondr is not a publisher, distributor, or editor of the content. We act solely as a technical and logistical intermediary enabling private, on-demand printing.

3. Content and Intellectual Property

3.1 Ownership of Content

All copyrights and intellectual property rights to the articles, texts, and images included in the magazine remain with their original authors or publishers.

Pondr:

  • Does not claim ownership or license to the content.
  • Does not reuse, resell, or redistribute content.
  • Processes content strictly for the purpose of fulfilling the Customer's individual order.

3.2 Customer Responsibility

By placing an order, the Customer confirms that:

  • They have lawful access to the selected content.
  • Printing the content for personal use does not infringe third-party rights.
  • The printed magazine is intended solely for personal use.

4. Contract Formation

The contract is concluded when:

  • The Customer submits an order, and
  • Pondr confirms acceptance of the order.

Orders are binding once confirmed.

5. Price and Payment

  • Prices are displayed before order confirmation and include VAT, if applicable.
  • Payment is made online via Stripe.
  • Pondr does not store full payment card details.

6. Made-to-Order and Personalized Product

Each magazine is produced exclusively according to the Customer's individual selection of articles and layout.

Under Section 1837 letter (d) of the Czech Civil Code, the Customer acknowledges that:

  • The magazine constitutes goods made to the Customer's specifications.
  • Such goods cannot be returned or exchanged once production has begun.

7. Right of Withdrawal and Refund Policy

7.1 No Statutory Right of Withdrawal

In accordance with Section 1837(d) of the Czech Civil Code, the Customer does NOT have the right to withdraw from the contract after production of the personalized magazine has started.

By placing the order, the Customer expressly agrees that:

  • Production begins immediately after order confirmation.
  • The right to withdraw from the contract is thereby lost.

7.2 Exceptions

A refund may be granted only if:

  • Production has not yet started, or
  • The product was not delivered due to a fault attributable to Pondr.

Refunds are not provided for:

  • Customer dissatisfaction with article content.
  • Printing outcomes inherent to the selected materials.
  • Delivery issues caused by incorrect shipping details provided by the Customer.

8. Printing and Delivery

  • Printing and shipping are performed by a third-party printer (currently Lulu).
  • Printed magazines are shipped directly from the printer to the Customer.
  • Pondr does not physically handle or inspect printed copies.

The Customer is responsible for providing accurate delivery information.

9. Complaints and Defects

If the delivered magazine has a manufacturing defect (e.g., missing pages, severe print damage), the Customer may submit a complaint within a reasonable time.

Each complaint is assessed individually. Due to the bespoke nature of the product, replacement or partial refund may be offered at Pondr's discretion.

10. Liability

To the maximum extent permitted by law, Pondr is not liable for:

  • Content legality or accuracy.
  • Copyright claims arising from Customer-selected content.
  • Indirect or consequential damages.

Total liability shall not exceed the price paid for the affected order.

Nothing in these Terms limits statutory consumer rights under Czech law, including liability for gross negligence or personal injury.

11. Termination

Pondr may suspend or terminate access to the Service if the Customer violates these Terms or applicable law.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Czech Republic.

Consumers may resolve disputes:

  • Before Czech courts, or
  • Through out-of-court consumer dispute resolution with the Czech Trade Inspection Authority (ČOI).

13. Changes to These Terms

Pondr may update these Terms from time to time.

Material changes will be communicated via the Service or email.
